1. Gift certificates should be spent within 12 months from the date of issuance, which is the date included on the gift certificate.
2. Some states may extend or void the expiration date. Expiration dates do not apply in CA, CT, NH, LA, MD, MA, ME, MT, ND, OK, RI, WA, and VT. Expiration dates do not apply in any other state solely to the extent as prohibited or limited by law.
3. Gift certificates are not redeemable for cash and cannot be returned for a cash refund, except to the extent required by law.
4. CertifiChecks, Inc. reserves the right to refuse payment or charge back gift certificates to the accepting merchant if it has not been validly issued, has been altered, or is counterfeit.
5. Gift certificates are endorsable by accepting merchant only; other endorsements will not be honored.
6. Gift certificates may NOT be converted to ECheck or ACH by accepting merchant.
7. Gift certificates are redeemable for merchandise and services only.
8. Any and all applicable taxes on merchandise or services purchased using gift certificates are payable by the presenter.

10. CertifiChecks, Inc. has the right to close customer accounts and request alternative forms of payment if a fraudulently obtained gift certificate is redeemed and used to make purchases.
11. CertifiChecks, Inc. may provide gift certificate purchasers with information about the redemption status of gift certificates.
12. CERTIFICHECKS, INC. AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CERTIFICATES, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CERTIFICATE CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CERTIFICATE. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
13. CertifiChecks gift certificates are issued and sold by CertifiChecks, Inc., an Ohio corporation. By visiting CertifiChecks.com, you agree that the laws of the state of Ohio, without regard to principles of conflict of laws, will govern these gift certificate terms and conditions.
14. Any dispute relating in any way to CertifiChecks gift certificates shall be submitted to confidential arbitration in Dayton, Ohio, except that, to the extent you have in any manner violated or threatened to violate CertifiChecks, Inc.’s intellectual property rights, CertifiChecks, Inc. may seek injunctive or other appropriate relief in any state or federal court in the state of Ohio, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
15. CertifiChecks, Inc. reserves the right to change these terms and conditions from time to time in its discretion.
16. All terms and conditions are applicable to the extent permitted by law.
